Residential Permit Exemption for Certain Work Under $7,500
News Releases Posted on July 10, 2026 Effective July 1, 2026, House Bill 803 (HB 803) amended Florida law to provide a limited exemption from building permit requirements for certain residential work valued at less than $7,500.
We have become aware of inaccurate information circulating on social media suggesting that all residential projects under $7,500 are exempt from permitting. This is incorrect. The exemption established by HB 803 is limited and applies only when all statutory conditions are satisfied.
To qualify for the exemption:
- The work must be performed on a single-family dwelling.
- The total value of the work must be less than $7,500.
- The owner or contractor must submit the required written request for exemption by completing the exemption form and providing documentation demonstrating the nature and value of the work.
- The project may not be divided or phased into multiple smaller projects to avoid permitting requirements.
The exemption does NOT apply to: Electrical work, Plumbing work, Mechanical work or Gas work. Also work requiring a permit under the Florida Building Code, including but not limited to roof replacements, window replacements, exterior door replacements, siding installation or replacement, and other work affecting the building envelope or structural integrity. Additionally, any work performed on a structure located wholly or partially within a Special Flood Hazard Area, as defined by the Florida Building Code.
Please remember that the project value alone does not determine whether a permit is required. Many common residential improvement projects—including roofing, windows, exterior doors, and siding—continue to require permits regardless of project cost. Contractors and property owners should not rely on social media, online commentary, or unofficial interpretations when determining whether a permit is required.
Do not assume that your project qualifies for the exemption; you should always contact the Tamarac Building Code Department. Protect your home and your investment before beginning any home improvement project, take a moment to verify whether a permit is required. Obtaining the appropriate permits and inspections helps ensure that work complies with the minimum requirements of the Florida Building Code and can protect the safety, structural integrity, functionality, and insurability of your home.
